UK trade-and-hazard guidance by the Riskora Editorial Team
Road surfacing combines two very different noise exposures: continuous high-level exposure for the paver and roller operators, and impulsive exposure from cold-cutting and breaker work. Both fall squarely within the upper exposure action value of the Noise Regs 2005, and the controls must be specified for each. Surfacing crews working night shifts on highways have the additional issue that residential neighbours' sleep disturbance is a planning condition, not just an internal RAMS matter.

Control of Noise at Work Regulations 2005
Regulations 5-7
Lower action value 80 dB(A); upper action value 85 dB(A); exposure limit 87 dB(A) at the ear. Daily and weekly TWA exposure assessment.
Environmental Protection Act 1990
Section 79 (statutory nuisance)
Noise prejudicial to health or a nuisance is a statutory nuisance. Local authority may serve an Abatement Notice, particularly for night works in residential areas.
Every UK RAMS reviewer applies the hierarchy of controls in the order below. Defaulting straight to PPE is the single most common reason a RAMS fails review.
1. Eliminate
Use cold-mix surfacing (less hot-paver noise) for short-duration patching where specification permits.
2. Substitute
Hydraulic breaker with anti-vibration handles instead of pneumatic. Quiet-spec rollers (manufacturer-stated <100 dB(A)).
3. Engineering controls
Acoustic enclosures around generators. Mufflers on cut-off saws. Work scheduling to keep noisiest operations away from operatives in fixed positions.
4. Administrative controls
Job rotation between paver, roller and screed operators. TBT on noise exposure. Section 61 prior consent under Control of Pollution Act 1974 for any night works near residential property.
5. PPE (last line)
SNR 30dB ear defenders or moulded plugs. Annual audiometry.
Not addressing planning conditions or Section 61 consent for night works. Many local authorities require a Section 61 consent in advance and RAMS that ignore it create an enforcement risk that PCs will not accept.

Surfacing of A41 north of Aylesbury, scheduled night shift 22:00-04:00. Section 61 consent obtained from Aylesbury Vale District Council (ref S61-2026-0334) — limits LAeq,15min to 65 dB at the nearest residential facade. Plant selection: Volvo P5870D paver (manufacturer noise 102 dB(A) at operator), Hamm HD+90 tandem roller (102 dB(A) at operator). All operatives wear SNR 30 dB ear defenders throughout. Job rotation every 2 hours between paver operator, screed-man and roller operator. Reverse alarms set to broadband (white-noise) type to reduce sleep disturbance. Annual audiometry on file for all crew. TBT on noise and Section 61 conditions before each shift.
Daily plant noise check (manufacturer data). Section 61 facade noise measurement at start of shift if requested. Hearing protection check at sign-on. Audiometry annually.
What is a Section 61 consent?
A prior consent under Section 61 of the Control of Pollution Act 1974 — issued by the local authority before noisy works start, setting noise limits and working hours. It protects the contractor from later abatement action provided the consent conditions are met.
Can road surfacing work happen at night without consent?
Legally, yes — Section 61 is voluntary, not mandatory. But if a complaint leads to an abatement notice, the contractor has no defence. In practice, principal contractors and highways authorities require consent in advance for any night works near residential property.
Are paver operators above the upper noise action value?
Almost always — typical paver operator positions exceed 100 dB(A) at the ear. Mandatory hearing protection, audiometry and exposure-controlled job rotation are required.
